Certain products or services may be available exclusively online through the Website or the Store. These products or services may have limited quantities and are subject to return or exchange only according to the following requirements: (a) the return or exchange must be requested to [shop@visional.inc ] within thirty (30) days after the delivery; (b) the reason for return or exchange is limited to damage or defect to the products; (c) the products must be unused and in its original condition with all accessories and original packaging; and (d) the return expenses are borne by Visional Pop for customers in the U.S.A., while the return must be shipped back to Visional Pop at the customer's expense for international orders. The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of the Terms of Service and/or the Agreement.

Without prior written approval from Visional Pop, you may not assign or transfer to a third party, allow a third party to succeed, provide as security to a third party, or otherwise dispose of the Agreement, or the rights and obligations arising from or in relation to the Terms of Service or the Agreement.

SECTION 18 – NO WAIVER

Visional Pop’s failure to enforce any provision under the Terms of Service or the Agreement or to exercise any rights or remedies under the Terms of Service or the Agreement, or delay in exercising such rights or remedies shall not be interpreted as a waiver of such enforcement of provision nor exercise of rights or remedies by Visional Pop.

SECTION 19 - GOVERNING LAW AND DISPUTE RESOLUTION

The Terms of Service and the Agreement shall be governed by and construed in accordance with the laws of the State of California, U.S.A., without reference to its conflict of laws provisions, and the rights and remedies of the parties shall be determined in accordance with such laws.

Any matter, dispute or controversy between you and Visional Pop arising out of or relating to the Terms of Service or the Agreement shall be exclusively submitted to any federal or state court located in the State of California, U.S.A.

You can access the most current version of the Terms of Service at any time on the Website.

Visional Pop reserves the right, at its sole discretion, to update, change, or replace any part of the Terms of Service by publishing updates and changes on the Website. It is your responsibility to check the Website periodically for such updates or changes. Your continued use of or access to the Website, the Store, or the Services following the publication of any updates or changes to the Terms of Service constitutes acceptance of those updates or changes.
