The Store is hosted on Shopify Inc. They provide Visional Pop with the online e-commerce platform that allows Visional Pop to sell Visional Pop’s products to you and to provide you with the Services. If an agreement is executed between you and Visional Pop in relation to use of the Website, the Store, or the Services (e.g., a purchase agreement for products sold on the Store; an “Agreement”), such Agreement shall be governed by the Terms of Service.

SECTION 3 - PRODUCTS OR SERVICES

Certain products or services may be available exclusively online through the Website or the Store. These products or services may have limited quantities and are subject to return or exchange only according to the following requirements: (a) the return or exchange must be requested to [shop@visional.inc ] within thirty (30) days after the delivery; (b) the reason for return or exchange is limited to damage or defect to the products; (c) the products must be unused and in its original condition with all accessories and original packaging; and (d) the return expenses are borne by Visional Pop for customers in the U.S.A., while the return must be shipped back to Visional Pop at the customer's expense for international orders. Any return or refund that does not satisfy these requirements will be subject to Visional Pop’s sole discretion. Visional Pop has made every effort to display as accurately as possible the colors and images of products that appear on the Website or the Store. Visional Pop cannot guarantee that your computer monitor's display of any color will be accurate.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of the Terms of Service and/or the Agreement.

Without prior written approval from Visional Pop, you may not assign or transfer to a third party, allow a third party to succeed, provide as security to a third party, or otherwise dispose of the Agreement, or the rights and obligations arising from or in relation to the Terms of Service or the Agreement.

SECTION 18 – NO WAIVER

Visional Pop’s failure to enforce any provision under the Terms of Service or the Agreement or to exercise any rights or remedies under the Terms of Service or the Agreement, or delay in exercising such rights or remedies shall not be interpreted as a waiver of such enforcement of provision nor exercise of rights or remedies by Visional Pop.
